Article 1: Scope of Application

These General Terms and Conditions of Sale (hereinafter the "Terms") apply, without restriction or reservation, to all sales concluded by the company BlueprintCommerce LLC (hereinafter "the Seller") to consumers and non-professional buyers (hereinafter "the Customers" or "the Customer"), wishing to acquire the products offered for sale by the Seller on the website blueprintplanners.com (hereinafter "the Site").

These Terms specifically outline the conditions for ordering, payment, delivery, and management of any potential returns or claims.

The validation of the order by the Customer constitutes acceptance without restriction or reservation of these Terms. The Customer acknowledges having the requisite capacity to contract and acquire the products offered on the Site.

Article 3: Product Characteristics

The products offered for sale on the Site are exclusively digital products (dematerialized interactive PDF files). These are digital planners, agendas, and journals designed for use on a tablet (e.g., iPad) with a stylus and PDF annotation applications (such as GoodNotes, Notability, Xodo, etc.).

The main characteristics (title, description, features, visuals) are presented on each product page. The Seller takes the greatest care in presenting the products. However, slight differences in rendering (especially in color) may occur depending on the screen or tablet used by the Customer. These differences cannot engage the responsibility of the Seller.

No physical product will be shipped to the Customer's postal address.

Article 4: Pricing

The prices of the products are indicated in Euros (EUR) on the Site. Unless otherwise stated, prices are all taxes included (VAT/Sales Tax) for residents of countries where taxes are applicable according to current local legislation (the Stripe payment platform handles the possible calculation of applicable sales taxes according to the Customer's jurisdiction).

The Seller reserves the right to modify its prices at any time, but products will be billed based on the rates in effect at the time the order is recorded by the Customer.

Prices do not include expenses related to equipment (tablet, stylus) or third-party software (GoodNotes, Notability) required to use the digital products. The acquisition of these tools is the strict responsibility of the Customer.

Article 5: Orders

It is the Customer's responsibility to select on the Site the products they wish to order, according to the following methods:

• Selection of products and addition to cart (or direct purchase via the "Buy Now" button).
• Verification of the order details.
• Entry of billing information (Name, Email, Address, Phone if required).
• Selection of payment method.
• Validation of the order by clicking the payment button.

The sale will only be considered final after sending the Customer confirmation of the order acceptance by the Seller via email, and after full collection of the price by the Seller via the Stripe platform.

Any order placed on the Site constitutes the formation of an online contract concluded at a distance between the Customer and the Seller.

Article 6: Payment Terms

The price is payable in full and in a single payment upon validation of the order.

Payment is made by credit card (Visa, Mastercard, American Express) or via digital wallets (Apple Pay, Google Pay) through the secure payment provider Stripe, Inc. Stripe is an independent, PCI-DSS Level 1 certified payment processor. Payment data is exchanged in encrypted mode using TLS/SSL protocol. BlueprintCommerce LLC has no access to your complete card details at any time.

By completing a purchase, you also agree to Stripe's own Terms of Service, available at stripe.com/legal/ssa, and acknowledge Stripe's Privacy Policy at stripe.com/privacy.

In case of payment failure (refused card, insufficient funds), the order will not be validated and the digital files will not be delivered.

Article 7: Delivery of Digital Products

As these are dematerialized digital products, delivery consists of the provision of a download link.

Once payment is validated, the Customer is automatically redirected to a confirmation page, and an email containing the download link(s) is sent to the email address provided during the order. The Customer then has the interactive PDF file which they can save to their device.

If you do not receive the email (check your spam/junk folders), the Customer is invited to contact customer service at support@blueprintplanners.com with proof of their purchase.

Article 8: Absence of Right of Withdrawal

In accordance with legal provisions regarding the supply of digital content not supplied on a tangible medium whose performance has begun after prior express agreement from the consumer (immediate download), the Customer's right of withdrawal may be limited once the download link is accessed.

However, this does not mean you have no recourse. If you experience a significant issue with your product, please contact us within 7 days of purchase. We will work with you to resolve the problem, and in eligible cases, we will process a refund. Please see our Refund Policy for full details.

If you encounter difficulties using the product, our team will assist you in resolving the problem at no additional cost.

Article 9: Intellectual Property

The content of the Site, as well as all digital products sold (text, designs, graphics, structural grids, internal hyperlinks), are the exclusive property of BlueprintCommerce LLC and are protected by US and international intellectual property and copyright laws.

The purchase of a product only grants the Customer a personal, non-exclusive, and non-transferable license to use. This license is strictly limited to domestic and individual use.

Article 10: Ban on Resale and Copyright Infringement

It is strictly prohibited, on pain of civil and criminal prosecution:

• To resell, distribute, giveaway, or share the PDF files purchased on the Site for free.
• To modify the original files to extract the design, pages, or code in order to create a derivative competitive product.
• To publish blank files on forums, Facebook groups, file-sharing platforms, or social networks.
• To use products for commercial purposes (e.g., offering the original planner as a "bonus" to your own clients without our agreement).

BlueprintCommerce LLC uses metadata tools and invisible digital footprints in its PDFs to trace illegal file sharing. Any Customer caught in violation will have their license revoked and faces heavy financial penalties for copyright infringement.

Article 11: Force Majeure

The execution by the Seller of its obligations under these terms will be suspended in the event of the occurrence of an act of God or force majeure that would hinder or delay its execution. These events include, but are not limited to: natural disasters, war, riots, internet network outages, major cyberattacks affecting our servers or our payment provider (Stripe).

The Seller will notify the Customer of the occurrence of such an act of God or force majeure as soon as possible.

Article 12: Personal Data and Privacy

The collection and processing of the Customer's personal data are carried out in compliance with the General Data Protection Regulation (GDPR) and current laws, particularly for European customers. The requested information is necessary for processing the order and issuing the invoice.

The Customer has the right to access, rectify, erase, limit, port, and withdraw their consent by simply requesting via email to support@blueprintplanners.com.

Article 13: Applicable Law and Language

These Terms may be translated into several languages, but the certified English text shall prevail in the event of a dispute.

In accordance with the company's headquarters, these General Terms and Conditions are governed and subject to the Law of the State of New Mexico, United States. However, if the Customer is a consumer residing in the European Union, they benefit in any case from the mandatory provisions of the law of their country of residence.

Article 14: Dispute Resolution

For any difficulty or claim related to an order, the Customer is invited to primarily contact customer service (support@blueprintplanners.com) to seek an amicable solution.

Any dispute that may arise concerning the interpretation or execution of these Terms, and which cannot be resolved amicably, will be submitted to the competent courts. For US consumers, the courts of Albuquerque, New Mexico will have jurisdiction. European consumers may seize the jurisdiction of their place of residence.

Article 15: Modification of Terms

The Seller reserves the right to modify these General Terms and Conditions of Sale at any time. The new version of the Terms will only apply to orders placed after it is posted on the Site.

The Customer is advised to save or print the Terms in effect at the time of their order.

Article 16: Absence of Medical Advice

The tools included in the planners (mood tracking, gratitude, ADHD task management, dopamine boosters) are developed based on self-help concepts in collaboration with feedback from neurodivergent users.

However, BlueprintCommerce LLC is not a healthcare provider. The grids, texts, and information contained in our digital products do not constitute medical, psychological, or psychiatric advice. They do not replace therapy, diagnosis, or treatment prescribed by a healthcare professional.

Article 17: Liability and Compatibility

The Seller guarantees that the interactive PDF files are functional and tested. Nevertheless, the user experience heavily depends on the Customer's hardware (tablet model, stylus) and the third-party application used (GoodNotes, Notability, Xodo).

BlueprintCommerce LLC cannot be held responsible if a third-party application performs an update making the PDF hyperlinks obsolete or changing their behavior. Our files respect ISO interactive PDF standards. No refund will be granted under the pretext that your specific application does not correctly display standard PDF links, if it is proven that this file opens normally on classic PDF readers (Adobe Acrobat, Preview, GoodNotes).

Article 18: Hosting and Link Availability

After purchase, the download link contained in your email is valid for an unlimited number of downloads for 30 days to ensure the security of our servers against brute-force attacks.

After this period, the file must be physically saved to your device or your personal Cloud (Google Drive, iCloud, Dropbox). In the event of the loss of your file beyond 30 days, manual access must be requested from customer service along with the provision of your authentic order number (Stripe ID).

Article 19: Acceptance

The fact of a natural or legal person ordering on the website blueprintplanners.com carries full adherence and acceptance to these General Terms and Conditions of Sale, which is expressly recognized by the Customer, who renounces, in particular, to rely on any contradictory document, which would be unenforceable against BlueprintCommerce LLC.
